Terms and Conditions of Sale and Website Use

1. About these terms
These terms apply to consumer purchases from the UK/EU store at somethingandnothing.co and to your use of that website. Please read them before ordering.
These terms work with our Privacy Policy, Cookie Policy, Returns and Cancellation Policy, Subscription Policy and any delivery information shown at checkout. Nothing in these terms limits rights that cannot legally be excluded.
Trade, wholesale and other business purchases are subject to separately agreed business terms and are not governed by these consumer terms. Trade customers may contact us directly or use an approved trade channel such as Faire.

3. Eligibility and ordering
You must have legal capacity to enter a contract. If you are under the age at which you can enter a binding purchase contract in your country, an authorised parent or guardian must place the order.
To order, select products, provide the requested information and submit payment through checkout. You are responsible for checking the order, address and contact details before submitting it.
The acknowledgement shown or emailed after checkout confirms receipt of your order; it does not necessarily mean we have accepted it. A contract is formed when we send an order acceptance or dispatch confirmation, or when we dispatch the products, whichever occurs first.
We may refuse or cancel an order before acceptance where, for example:
a product is unavailable;
the price or description contains an obvious error;
payment is not authorised;
fraud or security checks indicate material risk;
the delivery address is outside our available area;
a legal restriction prevents supply; or
an order appears to be for unauthorised resale rather than personal use.
If we cancel after taking payment, we will refund the affected amount. Our Privacy Policy explains automated fraud checks and how to ask for human review.
4. Products and information
We take reasonable care to describe products accurately. Packaging, colour and presentation may vary slightly from images. Product recipes, ingredients and nutritional information can change, so check the label supplied with the product before consumption. If website information conflicts with the physical label or you have an allergy or intolerance question, do not consume the product and contact us.
All products are subject to availability. We may limit quantities where reasonably necessary for stock management, fraud prevention or fair consumer access.
5. Prices, VAT and payment
Prices shown for the UK/EU store include applicable VAT unless we clearly state otherwise. Delivery charges and any other unavoidable charges are shown before you place the order.
We deliver only to United Kingdom and European Union destinations made available at checkout. We do not deliver through this store to non-EU countries, including Norway or Switzerland. Customers ordering to the destinations offered at checkout should not normally be charged import duties for the movement of the order within the applicable UK or EU fulfilment route.
We accept the payment methods displayed at checkout, which may include Shopify Payments, Visa, Mastercard, American Express, Shop Pay, Apple Pay and Google Pay. Payment providers may apply their own terms and checks.
If a price is clearly incorrect and you could reasonably have recognised the error, we may cancel before dispatch and refund any payment. Otherwise, the price confirmed when the contract is formed applies.
6. Delivery
Available destinations, options, charges and estimated delivery times are displayed at checkout. UK deliveries may use DPD; EU and other UK deliveries may use different warehouse and carrier partners selected for the destination.
Delivery dates are estimates unless we expressly agree a fixed date. We will deliver without undue delay and within any mandatory legal deadline. If a delay is material, contact us so that we can agree a new date or apply your statutory cancellation rights where available.
You must provide a complete and accurate delivery address and reasonable delivery instructions. If delivery fails because information supplied by you is wrong or no one can accept the parcel, we may charge reasonable redelivery or return costs where the law allows.
Risk of loss or damage passes to you when you, or a person you nominate other than the carrier, physically receives the products. You own the products once we have received payment in full and delivery has occurred.
7. Changing or cancelling an order
Contact george@somethingnothing.co as soon as possible. We may be able to change or stop an order before processing, but we cannot promise to do so once warehouse processing has begun.
Your statutory cancellation and return rights are described in our Returns and Cancellation Policy. An inability to stop a processed order does not remove those rights.
8. Subscriptions
Subscriptions renew and charge at the interval selected at checkout until cancelled. You can cancel at any time without a minimum commitment, provided cancellation reaches the subscription system before the next order is processed. A cancellation submitted after processing takes effect for later orders; statutory rights may still apply to the processed order after delivery.

9. Returns, refunds and faulty goods
Our Returns and Cancellation Policy explains the statutory cooling-off period, return process, return costs and refund timing.
Products must be of satisfactory quality, fit for purpose and as described, subject to the mandatory law applying where you live. If a product is faulty, damaged, unsafe, not as described or incorrect, email us promptly with the order number and, where reasonable, photographs. We may offer a replacement, price reduction or refund as required by law. We normally do not require visibly damaged or incorrect products to be returned unless we provide instructions and cover the appropriate cost.
10. Promotions and discount codes
Promotions are subject to the terms displayed with them. Unless we say otherwise, codes cannot be exchanged for cash, combined or applied retrospectively. We may withdraw or correct a promotion where there is an obvious error, fraud or misuse, without affecting orders already validly accepted.
11. Accounts
You are responsible for keeping account credentials confidential and for information supplied through your account. Tell us promptly if you suspect unauthorised access. We may suspend an account where reasonably necessary to protect customers, the website or our business.
12. Website content and acceptable use
The website and its content, branding, designs, text, images and software are owned by us or licensed to us and are protected by intellectual-property law. You may view and use the website for personal, non-commercial shopping. You must not, without permission:
• copy, exploit or commercially republish substantial website content;
• interfere with security or operation;
• introduce malware or harmful code;
• scrape the website in a way that breaches law or materially disrupts the service;
• misuse another person's account or personal data; or
• use the website for unlawful, fraudulent or abusive activity.
Third-party links are provided for convenience. We are not responsible for a third party's website, products or terms.
13. Our responsibility to you
We are responsible for losses that are a foreseeable result of our breach of these terms or failure to use reasonable care and skill. We are not responsible for losses that were not foreseeable when the contract was formed, or for business losses suffered by a consumer.
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your mandatory consumer rights.
We do not guarantee that the website will always be available or free of minor errors. We may suspend it for maintenance, security or circumstances beyond our reasonable control, but this does not affect an accepted order or statutory rights.
14. Events outside our reasonable control
We are not responsible for delay caused by an event outside our reasonable control. We will take reasonable steps to minimise the effect and contact you if the delay is significant. If there is a substantial delay, you may have a right to cancel and receive a refund for products not supplied.
15. Complaints
Email george@somethingnothing.co with your name, order number and a clear description of the issue. We will try to resolve the complaint fairly and within a reasonable time. You may also use any statutory consumer dispute or enforcement route available in your country.
16. Governing law and courts
These terms are governed by the law of England and Wales. If you are a consumer living elsewhere in the UK or in the European Union, you also retain the protection of mandatory consumer laws in your country of residence.
You may bring proceedings in the courts of England and Wales or, if consumer law gives you that right, in the courts of the country where you live. We may bring proceedings against a consumer only in a court permitted by applicable consumer law.
17. Other important terms
If any part of these terms is unlawful or unenforceable, the remainder continues to apply. A delay in enforcing a right is not a waiver. We may transfer our rights and obligations as part of a business sale or restructuring, provided this does not reduce your rights. You may transfer your rights only where the law permits or with our consent.
No person other than you and us has a right to enforce these terms, except where mandatory law provides otherwise.
18. Changes to these terms
We may update these terms for future orders. The version in force when your contract is formed applies to that order, unless a change is required by law or you expressly agree to it. Changes to subscription services are dealt with in the Subscription Policy.
